1. Acceptance of Terms

By accessing and using our website, you agree to comply with these terms and conditions.

2. Use of the Website

  • You may make use of our website for personal, non-commercial, personal consumption and use of our goods, at your own risk.
  • You must not engage in any unlawful or harmful activities.
  • The Spice Factory takes no responsibility to injury, physical, mental nor loss of property or other personal information.
  • Please provide feedback regarding our website as we would like to impress and improve consistently.

3. Further Information

  • We strive to provide accurate product descriptions, but we do not guarantee their completeness or accuracy.
  • Prices are subject to change without notice.
  • We do not accept responsibility for courier fees when returning faulty goods.
  • We do not accept responsibility for damages due to courier neglect.
  • We do not accept responsibility for any personal damages/injury/physical/mental loss in any way shape or form.

4. Payment and Refunds

  • Payment methods are stated and accepted via our online payment portal. Your purchase will be accepted and processed as an order once The Spice Factory has received the proof of payment via our payment host.

Refund Policy:

  • Returnable Goods: Refunds are not accepted for glass items and courier neglect.

  • Courier: All courier fees will be at the account of the customer.

  • If there is a fault with a product the consumer must be prepared to send the product back at their own account, and we will investigate the issue. If it is a mistake/issue on our side, we will be responsible for the courier costs back to the customer with the amended products.

  • Refund Timing: Will occur within 5-10 days of purchase.

  • Claim Process: Customers will be able to lodge a refund/return claim within 7 days of the receipt of the purchase. This process is possible by calling The Spice Factory and lodging the issue.

  • Exchange Rules: Please note that exchanges due to an incorrect flavour being ordered by the customer, will not be accepted nor exchanged. The refund policy of The Spice Factory is to provide a replacement item for faulty items once the fault has been reviewed by The Spice Factory. This does not include glass items as these are non-refundable.

5. Intellectual Property

  • All content on our website is protected by intellectual property laws, and the reproduction or falsification of The Spice Factory information, those responsible will be prosecuted and held liable for damages.
  • You may not reproduce, distribute, or modify any content without written consent/permission from the owner of The Spice Factory. Failure to comply will result in legal action being taken against the responsible party.

6. Privacy

  • Because we value your right to privacy, we make every effort to abide by the POPI Act’s legal requirements, which govern how we gather, handle, retain, disclose, and destroy any personal information you have given us.

Why We Gather Personal Data:

  • In order to communicate with you over the phone, online, or by email, we need your personal information. This allows us to: answer any questions or comments you may have; notify you of new services; process, validate, and verify information and requests for the supply of services; use the information for the purposes for which you specifically provided it; and in general to enhance your online experience.

  • We only collect personal information for the purposes of completing an online order and this information will not be abused.

Young People:

  • Prior to processing such personal information, we will need the approval of your parent(s), guardian(s), or other competent/guardian persons if you are under the age of eighteen (minor). As we will not accept under eighteens orders unless approved via an adult.

Information Processing:

  • We will disclose your personal information to the following parties: 1. to comply with applicable law or legal process served on our business; 2. to protect and defend our business’s rights or property; and 3. to employees and/or other third parties who help us provide services to you and need your personal information to do so properly and effectively. We’ll make sure that any staff members and outside service providers who have access to your personal data understand the importance of personal privacy.

We will:

  1. We will treat your personal information with strict confidentiality;
  2. Implement the necessary organizational and technical safeguards to ensure that it is kept safe and protected against unauthorized or unlawful processing, accidental loss, destruction, damage, alteration, disclosure, or access.

  3. We will notify you as soon as we become aware of any unauthorized use, disclosure, or processing of your personal information.

  4. We will upon reasonable request, provide you with reasonable proof of our compliance with our obligations under this policy.

  5. We won’t keep your personal information longer than is necessary, unless we are required by law to do so, or you provide your consent for us to hold your information.

7. Dispute Resolution

  • Any disputes will be resolved through negotiation or mediation, please contact us if there are disputes as we will attempt to resolve these as best we can.
  • If necessary, legal action may be taken, against the offender and will be for their account.
